Cascadia Windows & Doors -Limited Warranty for Installation Works
Cascadia Windows Ltd. (the "Installer") warrants to the “Client” only, that with respect to the installation works carried out by the Installer at the project address, the Installer’s installation of any windows, doors, window wall, storefront systems, and other materials supplied and installed by the Installer (the “Installation Works”), will not contain defects in workmanship for a period of two (2) years from the date that the Installation Works are substantially completed, as reasonably determined by the Installer at its sole discretion.
For clarity, this Limited Warranty only provides warranty coverage for the Installation Works and does not provide warranty coverage for any manufacturing or quality defects in the products or materials supplied by the Installer. Furthermore, this Limited Warranty is subject to the following terms and conditions:
- To make a claim under this Limited Warranty, the Client must:
- (a) notify the Installer in writing within 30 days after an alleged warrantable defect in the Installation Works becomes known to the Client or should have become known in the normal course of maintenance of the Installation Works; and
- (b) provide the Installer clear, free and timely access to relevant areas of the installations, where the Installation Works may require inspection, repair or replacement, before any such installations are uninstalled, removed, or destroyed by the Client or any third party.
- The Client’s failure to notify the Installer strictly in accordance with this provision will relieve the Installer of any further obligations or liabilities under this Limited Warranty.
- If a defect in the Installation Works is alleged, the Installer will promptly inspect the installation site and will determine whether in fact a warrantable defect exists.
- In the event that there is any warrantable defect, the Installer’s liability is limited to, at its exclusive election, the repair, replacement, or re-installation of any relevant Installation Works, so that the defect in the Installation Works is corrected. For clarity, this Limited Warranty does not cover labour or any other repair, replacement, installation or fabrication costs associated with the removal or re-installation of any overlying materials or finishes around the Installation Works as originally installed by the Installer.
- The warranty period under this Limited Warranty extends only to the remaining warranty period for the original Installation Works, and in no event will the original warranty period be extended due to any work conducted to correct any defect under this Limited Warranty.
- If the Client alleges any defect that is determined in accordance with this Limited Warranty to not be a warrantable defect, then the Client will be liable to pay the Installer for the Installer’s site inspection, immediately upon the Client being invoiced based on the Installer's then standard rates for time and materials.
- This Limited Warranty will be void, and the Installer will not be liable for any loss or damage, or for any failure or poor performance of the Installation Works, in the event of:
- (a) a failure by the Client to strictly comply with the procedures for making a claim under this Limited Warranty as set out at item 1, above;
- (b) any alteration, neglect, misuse or abnormal use of the Installation Works;
- (c) that the Installation Works are not maintained in accordance with the maintenance guide and other specific instructions provided to the Client by the Installer, which are hereby incorporated by reference into this Limited Warranty;
- (d) any impact upon the Installation Works because of any accident, fire, war, flood, earthquake, or act of God; or
- (e) any defects caused by depreciation or normal wear.
- This Limited Warranty document provides the Installer’s maximum liability for the Installation Works. The Installer will not be liable for any indirect, special, exemplary, aggravated, punitive, consequential or incidental damages. Except for the express limited warranty described herein, the Installer has provided no other express or implied warranty, including implied warranties of merchantability and fitness for a particular purpose to the Client or any subsequent user of the Installation Works. In the event that any applicable statutory law precludes exclusion or limitation of implied warranties, the duration of any such warranties will be no longer than, and the time and manner for making any warranty claims will be the same as, that provided herein.
- No variation or change from this Limited Warranty will be binding upon the Installer unless made in writing specifically referencing this Limited Warranty and signed by an officer of the Installer.
